The Stamperia Regionale Braille ETS is registered on the list of the Ministry of Culture – Directorate General for Libraries and Copyright among the Authorised Entities, in accordance with article 71-bis, paragraph 2-bis of Law No. 633/1941 and the Decree of the President of the Council of Ministers of 6 July 2020 – Exception for visually impaired, partially sighted, perceptually impaired and some physically disabled persons.
That provision, implementing EU Directive 2017/1564, provides an exception to a series of exclusive rights concerning certain types of works, in favour of specific categories of beneficiaries (blind, partially sighted, perceptually or reading‑impaired, or physically disabled persons), provided that such works are previously transformed into “accessible format works”. To allow the exercise of this exception, not only for the beneficiaries themselves for personal use, but also for certain bodies, legally defined as “authorised entities”, it is permitted to make, without profit‑making purpose, an accessible‑format copy of a work or other material to which they legitimately have access (art. 71‑bis, paragraph 2‑quinquies).
In relation to the provisions set out above, the Stamperia Regionale Braille ETS, respecting the current rules on the processing of personal data, makes known the actions taken to ensure formal and substantial compliance with the obligations arising from its recognition as an “Authorised Entity” pursuant to art. 71‑bis, paragraph 2‑undecies:
Lett. A) “distribute, communicate and make accessible copies in accessible format exclusively to beneficiaries or to other authorised entities”
- The Stamperia carries out the transcription and supply of texts in different accessible formats (Braille, large‑print “Large Print”, files for speech synthesis/Braille displays/magnification software), and audio‑recorded outputs, at the request of its blind/partially sighted users. The requests, complete with all details about school/university and class/course attended, as well as the technical specifications needed for proper usability (font size, line spacing, alternate lines, etc.), are submitted by the users themselves, if adults, or through their families, their schools, the local sections of the Unione Italiana dei Ciechi e degli Ipovedenti to which they belong, or the regional Tiflodidactic Consultancy Centres.
- Upon request by school or library institutions that wish to enlarge their book collections with versions usable by people with visual impairment, paper copies in Braille or large print are supplied at the sole cost of printing and of managing the order.
Lett. B) “take appropriate measures to prevent the unauthorised reproduction, distribution, public communication or making available to the public of copies in accessible format;”
- Texts supplied in Braille or in large print for partially sighted users (“Large Print”) are made available to the users in a single copy, within which, at the time of printing, the following wording will appear:
“Copy in accessible version produced by Stamperia Regionale Braille ETS (Authorised Entity pursuant to art. 71‑bis, paragraph 2‑bis of Law No. 633/1941) and granted to the visually impaired person to whom this volume is sent for exclusively personal and study use – All rights reserved”
- Accessible‑format files (.doc/.pdf/.rtf/.mp3) are supplied to the user encrypted and with a personal password; at the moment of the request, the beneficiary will sign a declaration acknowledging their knowledge and respect of copyright legislation and committing to exclusively personal use of the material received.
Lett. C) “exercise due diligence in handling works or other material and the respective accessible‑format copies, and in recording all operations carried out;”
- The acquisition of texts takes place through the direct purchase of paper copies and, where available, by requesting a PDF version through the Biblioteca Italiana per Ciechi “Regina Margherita” in Monza, which has signed an agreement with AIE (Associazione Italiana Editori) for the exchange of PDF versions of school textbooks;
- For the adaptation and transformation of texts into usable works, the following operations are generally required:
- digital editing of the text or import from a PDF source;
- re‑reading, checking and spelling correction;
- layout and formatting of the text according to the specifications for the type of accessible version to be produced and the user‑specific technical requirements;
- supervision and testing;
- paper printing or file export;
- binding (for paper versions) and dispatch to the requesting user.
- The working files of the edited texts are stored in a secure electronic archive inaccessible to external parties and are used only and exclusively for possible re‑prints or adaptations to be supplied to other blind and partially sighted requesters;
- All operations related to transcription requests and to the working phases of production, printing or file sending are recorded and traceable on internal spreadsheets for the exclusive use of authorised staff;
- The list of texts available in different accessible versions is kept at the entity’s offices and is made available to eligible requesters and other authorised entities, upon request.
